These Terms of Service govern your use of ouzala.com and any purchase you make from us. Ouzala is operated by Outfinity Advertising, 137 Glasgow St., Suite 210, Kitchener, ON N2G 4X8, Canada. By browsing or ordering from this store you agree to these terms. Please read them before you buy.

1. Access and Account

You must be at least the age of majority in your province, state or country to place an order, or have the consent of a parent or guardian. If you create an account, you are responsible for keeping your password secure and for everything that happens under your account. Tell us immediately if you believe your account has been used without your permission.

2. Our Products

We work hard to describe and photograph every item accurately, but we cannot guarantee that your screen displays colours exactly as they appear in person, and small variations in finish, grain or shade are normal on handmade and natural materials. We may change, limit or discontinue any product at any time without notice.

3. Orders

Placing an order is an offer to buy, not a completed contract. We may accept or decline any order, in whole or in part, including where an item is out of stock, a price was listed in error, or the order appears fraudulent. If we decline an order you have already paid for, we refund you in full. Returns and refunds are governed by our Refund Policy.

4. Prices and Billing

All prices are shown in USD unless stated otherwise, and may change at any time before you place an order. You agree to provide current, complete and accurate billing information, and you authorise us to charge your chosen payment method for the full order total at the time you order. 5. Shipping and Delivery

Delivery windows published on this site are good-faith estimates, not guarantees. Risk of loss passes to you on delivery. Our full terms are set out in our Shipping Policy.

6. Intellectual Property

The Ouzala name, logo, site design, written content and photography are owned by us or used under licence, and are protected by copyright and trade mark law. You may not copy, reproduce, republish or exploit any part of this site commercially without our written permission.

7. Optional Tools

We may give you access to third-party tools we neither monitor nor control. They are provided on an "as is" and "as available" basis, without warranties of any kind. Any use you make of them is at your own risk, subject to that third party's own terms.

8. Third-Party Links

This site may link to websites we do not operate. We are not responsible for their content, accuracy, products or practices, and a link is not an endorsement. Review their terms and policies before you engage with them.

9. Relationship with Shopify

This store is hosted on Shopify, which provides the online platform that allows us to sell to you. Shopify is not a party to your purchase and is not responsible for the products we sell or the fulfilment of your order.

10. Privacy

How we collect, use and disclose your personal information is set out in our Privacy Policy. Where this document and the Privacy Policy conflict on privacy matters, the Privacy Policy governs.

11. Feedback and Submissions

If you send us ideas, suggestions, reviews or other material, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and publish it without compensation or attribution. We are under no obligation to keep submissions confidential or to act on them.

12. Errors and Omissions

Occasionally information on this site contains a typographical error, inaccuracy or omission relating to a price, description, availability or delivery time. We reserve the right to correct any error and to change or cancel an affected order, even after it has been submitted, and to refund you if it has been charged.

We may refuse service, terminate an account or cancel an order at any time if you breach these terms. Obligations and liabilities incurred before termination survive it.

We do not warrant that the site will be uninterrupted, secure or error-free.

16. Limitation of Liability

To the fullest extent permitted by law, Ouzala, Outfinity Advertising and their teams, suppliers and service providers are not liable for any indirect, incidental, special, punitive or consequential damages, including lost profits or lost data, arising from your use of this site or any product bought through it. Where liability cannot be excluded, it is limited to the amount you paid for the product concerned. Some jurisdictions do not allow these exclusions, so they may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless Ouzala and Outfinity Advertising from any claim or demand, including reasonable legal fees, made by a third party because of your breach of these terms or your violation of any law or the rights of a third party.

18. Severability

If any provision of these terms is found to be unlawful or unenforceable, that provision is severed to the minimum extent necessary and the remaining provisions continue in full force.

19. Entire Agreement

These terms, together with the policies published on this site, are the entire agreement between you and us and supersede any prior agreements or communications. Any ambiguity is not to be construed against the drafting party.

20. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in it, and the courts of Ontario have jurisdiction, without limiting any mandatory consumer protection rights you have where you live.
